Overview

Sassy Ava ("we", "us", "our") operates this online store and website (the "Store"). By visiting the Store or purchasing something from us, you agree to be bound by these Terms of Service (the "Terms"), including the additional policies referenced within them. These Terms apply to all visitors, customers and other users of the Store. Please read them carefully before placing an order. If you do not agree to all of these Terms, you may not use the Store or purchase our products.

Online Store Terms

By using the Store you represent that you are at least the age of majority in your place of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependants to use the Store. You may not use our products for any illegal or unauthorised purpose, and you may not transmit any viruses, worms or malicious code through the Store. A breach of any of these Terms will result in the immediate termination of your access to the Store.

Eligibility and Your Account

You are responsible for maintaining the accuracy of your account information and for all activity that takes place under your account. If you provide information that is untrue, inaccurate or incomplete, we may suspend or cancel orders associated with that information. You agree to update your account and other information promptly, including your email address and payment details, so that we can complete your transactions and contact you as needed.

Products and Pricing

We offer women's accessories — hair pieces, silk scarves and sunglasses. All prices are shown in US dollars (USD) and do not include shipping charges or applicable taxes, which are calculated and shown at checkout. Prices may change at any time without notice; the price charged for an order is the price shown at checkout when the order is placed and confirmed.

Many of our pieces are finished by hand. Scarves are rolled and stitched at the edges by hand, hair pieces are set and finished individually, and small variations in dimension, colour and finish are a natural characteristic of such work and are not defects. Natural materials — silk, velvet, pearl, acetate — each carry their own grain and character, which no photograph can reproduce exactly; we have made every effort to display colours and materials accurately, but the colour you see depends on your display.

We reserve the right to limit the quantities of any product, to discontinue any product at any time, and to refuse or cancel any order — including orders that appear to be placed by resellers or distributors — at our discretion. If we cancel or change an order, we will attempt to notify you using the contact details provided at checkout.

Accuracy of Billing and Order Information

You agree to provide current, complete and accurate purchase and account information for all purchases made through the Store, and to promptly update that information so we can complete your transactions and reach you if anything about your order needs attention.

Orders and Acceptance

Your order is an offer to purchase the products listed in it. An order is accepted, and a contract formed, when we send you an order confirmation by email. We may decline an order before acceptance for reasons including product unavailability, errors in product or pricing information, problems with payment authorisation, or suspected fraud. If we decline an order after payment has been taken, we will refund the full amount to your original payment method.

Shipping

Orders are prepared and dispatched in accordance with our Shipping Policy, which forms part of these Terms and can be read on the Store's shipping policy page. Delivery times given anywhere in the Store are estimates only and are not guaranteed.

Returns and Refunds

Returns, exchanges and refunds are governed by our Refund Policy, which forms part of these Terms and can be read on the Store's refund policy page.

Intellectual Property

The Sassy Ava name, the Store's design, all text, photography, graphics and product designs shown in the Store are the property of Sassy Ava or our content suppliers and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute or use any of this material for commercial purposes without our prior written permission.

User Comments and Submissions

If you send us comments, reviews, ideas or other submissions, you agree that we may use, edit, publish and distribute them in any medium without restriction and without any obligation to compensate you, to keep them confidential, or to respond. You are solely responsible for the content of anything you submit and for ensuring it does not violate the rights of any third party or any law.

Prohibited Uses

You may not use the Store: for any unlawful purpose; to solicit others to perform unlawful acts; to violate any regulations, rules or laws; to infringe upon the intellectual property rights of us or others; to harass, abuse, insult, harm, defame or discriminate against anyone; to submit false or misleading information; to upload malicious code; to collect the personal information of others; or to interfere with the security or operation of the Store.

Disclaimer of Warranties

The Store and all products are provided "as is" and "as available" without any representation, warranty or condition of any kind, either express or implied, except where such exclusion is not permitted by law. We do not warrant that the Store will be uninterrupted, timely, secure or error-free, or that any results obtained from its use will be accurate or reliable. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable consumer law.

Limitation of Liability

To the fullest extent permitted by law, Sassy Ava, and our directors, employees, suppliers and service providers, will not be liable for any indirect, incidental, special or consequential damages of any kind arising from your use of the Store or any products purchased through it, including lost profits, lost data or loss of goodwill, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from an order will not exceed the amount you paid for the products in that order.

Indemnification

You agree to indemnify and hold harmless Sassy Ava and our employees, suppliers and service providers from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will still be enforceable to the fullest extent permitted by law, and the unenforceable portion will be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.

Governing Law

These Terms and any contract formed through the Store are governed by and construed in accordance with the laws applicable in the jurisdiction in which our business is established, without regard to its conflict of law principles. Nothing in this clause limits any mandatory rights you hold under the consumer protection laws of your place of residence.

We may update these Terms from time to time by posting the revised version in the Store. The version in effect when you place an order governs that order. Your continued use of the Store following any change constitutes acceptance of the revised Terms.
